Data Protection Officer (DPO) for Schools
All schools are required to appoint a Data Protection Officer (DPO). The DPO can either be a school employee, or an outsourced provision.
If the DPO is in-house, they must:
- Not have any conflicts of interest. So members of the SLT (HT, DHT, SBP etc) should be excluded. Chairs and Governors should also be excluded, to avoid any potential for conflict.
- Be an ‘expert’ in data protection law. An ‘expert’ is not defined, but we would suggest a common-sense approach i.e. could this person command commercial fees, if they presented their expertise in the private marketplace?

Professional Clerking
Whether your school is maintained or a MAT / academy, the demands upon your clerk have increased. Both OFSTED and ESFA have higher expectations. A clerk is not an administrative note-taker. Rather, they are required to be a governance professional, trained to support governors / trustees and facilitate focused decision-making.
